1. Acceptance of Terms

By accessing or using the services provided by App Me Developers ("we," "our," or "us"), including the StudioDash mobile application, web platform, and appmedev.com website (collectively, the "Services"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Services.

2. Description of Services

App Me Developers provides:

  • StudioDash: A mobile-first management platform for fitness businesses, including class scheduling, member management, payment processing, and marketing tools.
  • Custom Development Services: Bespoke application development, design, and consulting services provided under separate agreements.

3. Account Registration

To use certain features of the Services, you must create an account. You agree to:

  • Provide accurate, current, and complete information
  • Maintain and promptly update your account information
  • Maintain the security and confidentiality of your login credentials
  • Accept responsibility for all activities that occur under your account
  • Notify us immediately of any unauthorized use of your account

You must be at least 18 years old (or the age of majority in your jurisdiction) to create an account.

4. Gym Owner (Admin) Terms

If you use our Services as a gym owner or administrator ("Admin"), you additionally agree to:

  • Provide accurate business information during the setup process
  • Comply with all applicable laws and regulations governing your fitness business
  • Ensure that your use of marketing and communication tools (email, SMS) complies with applicable anti-spam laws (e.g., CAN-SPAM, TCPA)
  • Maintain appropriate insurance and certifications for your fitness business
  • Be responsible for the content you publish through the platform (class descriptions, images, pricing)
  • Not use the Services for any unlawful purpose

5. Member (Customer) Terms

If you use our Services as a gym member ("Member"), you agree to:

  • Use the Services in accordance with your gym's policies and these Terms
  • Not misuse the booking system (e.g., booking classes you do not intend to attend)
  • Provide accurate payment information for transactions
  • Acknowledge that gym activities carry inherent risks and participate at your own discretion

6. Payments and Fees

6.1 Platform Pricing

StudioDash is free to set up and use. We generate revenue through a 2% platform fee applied to each transaction processed through the Services, in addition to standard payment processing fees charged by Stripe.

6.2 Payment Processing

All payments are processed through Stripe. By using the payment features, you also agree to Stripe's Terms of Service and Privacy Policy.

6.3 Refunds

Refund policies for individual transactions (e.g., class bookings, merchandise purchases) are set by the respective gym owner. We facilitate refunds through our platform but are not responsible for individual gym refund policies. Platform fees are non-refundable except as required by law.

6.4 Custom Development Services

Fees for custom development services are agreed upon in separate written agreements between App Me Developers and the client.

7. Intellectual Property

  • The Services, including all software, design, text, graphics, and other content, are owned by App Me Developers and protected by intellectual property laws.
  • You retain ownership of content you upload to the Services (e.g., gym logos, class descriptions).
  • By uploading content, you grant us a limited, non-exclusive license to use, display, and distribute that content as necessary to provide the Services.
  • You may not copy, modify, distribute, or reverse-engineer any part of the Services without our prior written consent.

8. Prohibited Uses

You agree not to:

  • Use the Services for any illegal or unauthorized purpose
  • Violate any applicable laws, rules, or regulations
  • Interfere with or disrupt the Services or servers
  • Attempt to gain unauthorized access to any part of the Services
  • Upload malicious code, viruses, or harmful content
  • Harvest or collect user information without consent
  • Use the Services to send spam or unsolicited communications
  • Impersonate another person or entity
  • Engage in any activity that could damage, disable, or impair the Services

9. Disclaimer of Warranties

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, APP ME DEVELOPERS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICES.

OUR TOTAL LIABILITY FOR ANY CLAIMS ARISING FROM OR RELATED TO THE SERVICES SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

11. Indemnification

You agree to indemnify and hold harmless App Me Developers, its officers, directors, employees, and agents from any claims, losses, damages, liabilities, and expenses (including reasonable attorneys' fees) arising out of or related to your use of the Services, your violation of these Terms, or your violation of any rights of another party.

12. Termination

We may suspend or terminate your access to the Services at any time, with or without cause, with or without notice. Upon termination:

  • Your right to use the Services will immediately cease
  • We may delete your account and associated data after a reasonable retention period
  • Provisions that by their nature should survive termination will remain in effect (including Sections 7, 9, 10, 11, and 13)

13. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the United States. Any disputes arising from these Terms or the Services shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association, unless you opt out of arbitration within 30 days of accepting these Terms by contacting us in writing.

14. Changes to These Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by posting the updated Terms on our website and updating the "Last updated" date. Your continued use of the Services after changes are posted constitutes your acceptance of the revised Terms.
